Renewal of Cover

All Full Members other than those domiciled in the USA or Canada are now automatically included in the scheme and no Certificates or renewal confirmation will be issued. Your BDA Membership Card is proof of cover.

Scope of Cover

The policy will indemnify the individual Member for a limit of £1 million for any single claim. There is a limit of a maximum of £2 million in any one year. The policy covers you “against claims which the Member shall become legally liable to pay arising out of professional service rendered or which ought to have been rendered in the course of the Member’s occupation as a dietitian.”

In addition, the policy will pay all costs and expenses incurred in connection with any claim which falls within this policy provided the limit of indemnity is not exceeded.

Exclusion

Limitations of cover have been kept to a minimum but the policy excludes any criminal act or the use of any property or vehicle.

Territorial Restrictions

There are no territorial restrictions other than for USA or Canada as the policy is issued on a world wide basis. Claims need not now be brought within the courts of the United Kingdom and Indemnity is provided in the court of origin of claim anywhere in the world other than USA or Canada.

Our underwriters will consider individual applications for cover in the USA and Canada.

Claims

The Member must give immediate notice in writing of any claim, or notice of an intention of claim, or any circumstance of which the Member becomes aware of which is likely to give rise to a claim to:

THE MEMBER SHOULD NOT ADMIT LIABILITY OR DIVULGE THE EXISTENCE OF INSURANCE TO ANY CLAIMANT OR POTENTIAL CLAIMANT.

In addition the Member shall endeavour to notify A Letton Percival & Company prior to testifying at any inquest or public hearing in any case where the Member has been in attendance or consultation.
