Transfer of Undertakings (Protection of Employment)

The Transfer of Undertakings (Protection of Employment) (TUPE) is the legal process that an employer uses to transfer its business or part of and the staff the employer employs to carry out that business or part of to another employer.

TUPE legislation provides protections for the dietitian that finds them being transferred from their current employer to another employer.  The dietitian transfers with their current terms and conditions of employment so should not suffer a detriment at the time of transfer.

If in the case of TUPE transfer from one NHS employer to another where Agenda for Change Terms and Conditions apply there will be no change.

Dietitians facing a TUPE transfer can seek advice and support from the local BDA Trade Union Representative or the Trade Union Office.
